Levara — Terms of Service

These Terms of Service ("Terms") govern your use of the Levara mobile application ("Levara", "the app"), operated by Sérgio Santos ("we", "us"). By downloading or using Levara you agree to these Terms. If you do not agree, please do not use the app.

1. What Levara is

Levara is a hiking companion for the island of Madeira, Portugal. It provides curated trail information, offline maps, GPS navigation, elevation data, transport notes, community features and an emergency SOS shortcut. Levara is an information and navigation aid only.

2. Safety — important, please read

Hiking and mountain activities are inherently risky. You use Levara and undertake any hike entirely at your own risk. Levara does not replace proper preparation, appropriate equipment, fitness, local knowledge, official trail notices, or good judgement.

Trail data, difficulty ratings, distances, times and elevation are provided in good faith but may be inaccurate, incomplete or out of date. Always check current conditions and official sources (e.g. IFCN Madeira) before setting out.
GPS accuracy, offline maps and altitude depend on your device and environment and may be unavailable or wrong.
The SOS feature depends on a working phone, mobile signal and the relevant emergency services being reachable. It is not guaranteed to work and is not a substitute for calling the emergency services directly. In an emergency in Madeira, dial 112.

To the maximum extent permitted by law, we are not liable for any injury, loss or damage arising from your use of the app or from any hike.

3. Accounts

Some features require an account. You are responsible for keeping your login details secure and for activity under your account. You may delete your account at any time from within the app.

4. Subscriptions, Trip Pass and payments

Levara offers paid plans (Levara Scout and Levara Pro) as auto-renewing monthly subscriptions, and a one-time Trip Pass that grants full access for a fixed period. All payments are processed by Google Play, subject to Google Play's terms.

Subscriptions may include a free trial; unless cancelled before the trial ends they convert to a paid subscription and renew automatically until cancelled.
You can manage or cancel a subscription at any time in your Google Play account. Cancelling stops future renewals; you keep access until the end of the current paid period.
The Trip Pass is a one-time purchase that grants access for its stated period and does not renew.
Refunds are handled according to Google Play's refund policy.

5. Community content and conduct

Levara includes community features such as group walks and chat. You are responsible for what you post. You agree not to post content that is unlawful, harassing, hateful, threatening, sexually explicit, or otherwise objectionable, and not to misuse the features or other users' data.

We operate a zero-tolerance approach to objectionable content. Users can report messages and block other users in the app. We may remove content and suspend or remove accounts that breach these Terms.

6. Acceptable use

You agree not to reverse-engineer, copy, resell or misuse the app or its data, not to interfere with its operation, and to use it only for lawful personal purposes.

7. Intellectual property

The app, its design and its content are owned by us or our licensors. Map tiles and trail geometry are provided by third parties (including Esri and © OpenStreetMap contributors) and remain the property of their respective owners.

8. Changes and availability

We may update, change or discontinue features at any time. We may update these Terms; continued use after changes means you accept the updated Terms.

9. Governing law

These Terms are governed by the laws of Portugal, and any disputes are subject to the competent courts of Portugal, without affecting any mandatory consumer rights you have where you live.
